Mein lieber Max-Albert!
Du kannst Dir denken, dass mir die Nachrichten Deiner letzten Briefe, insbesondere vom 1 d. M., sehr viel zu denken gegeben u. Sorge gemacht haben. Immerhin vertraue ich darauf, dass Du Dich bei Deinem Können, Deiner Erfahrung in der Technik u. bei Deiner Sauberkeit u. Fleiss durchschlagen wirst. Es muss ja das neu zu suchende Gebiet nicht gerade mit dem bisher gepflegten zusammenfallen, aber die Carenzvorteile würde ich der Firma nicht ohne Weiteres schenken, wenn sie nicht die Kraft hat, dem äusseren so ungebrechten u. harten Drucke zu widerstehen. Sobald Du (aber nur dann) etwas Geeignetes gefunden hast, kannst Du ja immer noch auf die Carenzvergütung verzichten, wenn es nötig waere. Bis dahin kannst Du mit Recht eine Vergütung oder auch ohne Carenz eine Abfindung (??) beanspruchen. Auch wenn Du in’s Ausland gehst,

könntest Du das Carrenzgeld zum mindestens in Deutschland auf einer Bank einzahlen u. liegen lassen, selbst wenn Du es nicht sogleich heranbekomsmt oder nur mit Verlust. Ein „Nichtstun“ braucht mit der Annahme der Carenzzahlung nicht verbunden zu sein. Rechte giebt man aber nicht ohne Grund auf, u. Du kannst später ja immer noch auf die Carenzzahlung verzichten, wenn es sich als richtiger erweist, also z.B. dann wenn Du überhaupt erst eine konkurrierende Stellung erhalten hast. Die Bewerbung um eine solche ist ja durch die Carenzzahlung wohl nicht von vornherein verboten? Wahrscheinlich müsstest Du erst im Zeitpunkt, wo Du die konkurrierende Stelle auch wirklich antrittst, der Firma Mitteilung unter Verzicht machen. Aber ob das erlaubt ist, kann ich nicht beurteilen, u. ich finde mich in den langen Paragraphen der beiliegenden Broschüre nicht zurecht. Da müsstest Du einen in dieser Materie wirklich Sachverständigen Juristen fragen.

Es giebt doch in Berlin noch Rechschutzstellen. (Der sehr ehrenwerte Verein D. Chemiker wird wohl fuer uns ebensowenig in Frage kommen wie der „Bund angest. Akademie techn. naturw. Berufe,“ der die Broschüre herausgab, falls er überhaupt noch existiert. Bitte verschaffe mir, wenn möglich, auch ein Exemplar der Broschüre). Aber der „Verband judischer Ingenieure u. Chemiker in Deutschland. E.V. (Berlin S.W.19 Lindenstr. 48/56 F. Donhof A. 7; 307) oder sein Nachfolger bei der „Reichsvertretung D. Juden Kanstr. 158“) wird wohl eine derartige Rechtsberatungsstelle haben, die Du vielleicht ev. fragen koenntest. Du schreibst mir nichts davon, ob überhaupt eine Carenzclausel in Deinem Anstellungsvertrag steht (u. mit welchelm Wortlaut?) Diese sollte doch nach S. 28 oben der Broschüre schon im Kontrakt stehen, u jetzt wäre es zu spät, sie erst noch nachträglich zu verlangen?
Hoffentlich ist H.H.F. anständig in Bezug auf geistiges Eigentum u. wird die Publikationen nicht mehr so lange verschleppt! Sie wären auch wichtig für Deine Zukunft.

Ist noch viel Material unveröffentlicht u. wann u wie erscheint es? Die grösste Sorge macht mir die Frage Deiner Verpflegung, wenn Du gezwungen wärest, die Neumann’sche pension zu verlassen. Es ist jammerschade, dass Du nicht längst eine auch in dieser Beziehung für Dich essensorgende Lebensgefährtin hast.
Auf die Linie der Figur etc. kommt es wahrhaftig am wenigstens an; das könntest Du schon von Deiner Mutter herwissen, welche die anmutigste u. beste Frau der Welt für mich u. mit der ich sehr glücklich war, auch ohne die ätherische Linie etc. – Aud die Geldfrage spielt bei der Ehewahl nicht mehr die Rolle wie früher, da die jungen Paare sich tapfer zusammen durcharbeiten. So ist z.B. auch meine in nächster Woche probeweise antretende Nachfolgerin von Frl. Bl. eine jung verheiratete Frau, die ihr 4 Monate altes Baby mitbringt, während der stellungslose Mann (Philoge) in Mannheim Stunden giebt. Sie wollen in 2-3 Jahren nach Palaestina gehen. Das Baby macht mir allerdings etwas Sorge, ob die Arbeit hier funktionieren wird. Es kommt erst später hierher nach u. ist vorläufig bei der Grossmutter.

You can imagine that the news from your latest letters, especially the one from the 1st of this month, worried me and gave me a lot to ponder. I’m always confident that you will be successful because of your ability, your experience in industry, your tidiness, and diligence. You new position doesn’t exactly have to coincide with your previous one, but I would not give the company your vacation benefits, especially if they do not have the strength to withstand external pressure. As soon as you have found a suitable position, you can then give up your vacation time if it would be necessary. Until then, you are within your rights to claim compensation or severance pay (??), even without vacation time. Moreover, when you go abroad,

you could at least deposit your vacation pay in a German bank and leave it there, even if you can’t withdraw it or it is lost. “Doing nothing” doesn’t have to be associated with the acceptance of vacation pay. You don’t give up your rights without a reason and you can always give up your vacation pay if it turns out to be justified, especially if, for example, you receive a competing position. Applying for such a position is probably not prohibited from the outset because of vacation pay. You would probably only have to notify the company of your waiver when you actually start the competing position. However, I can’t determine if that’s allowed, and I can’t find way around the long paragraphs in in the enclosed brochure.

Yet, there are positions in Berlin that are still protected by law. (The very honorable Association of German Chemists will be just as irrelevant for us as the Federation of Professionals in Technical and Scientific Professions, which published the brochure. Does it even still exist? If possible, please obtain a copy of this brochure for me.) However, the Association of Jewish Engineers and Chemists in Germany (Berlin S.W.19 Lindenstrasse 48/56 F. Donhof A. 7; 307) and its predecessor at the Reich’s Representative for German Jews (Kanstrasse 158) will certainly have a similar legal advice office that you could likely ask. You didn’t write anything to me about whether a vacation pay clause is in your employment contract (and how it is worded). According to the top of page 28 in the brochure, this clause should be stated in your contract. It would probably be too late to request this clause after the fact.
Hopefully, H.H.F is ethical regarding intellectual property and the publications will no longer be delayed for so long. They would also be important for your future.

Is there still a lot of unpublished material and when and how will it appear? My greatest concern is your diet if you were forced to leave Mrs. Neumann’s boarding house. It’s a shame that you don’t have significant other who prepares meals for you in this respect.
Figure doesn’t really matter anyhow. You should already know this from your mother, who was the most charming and best wife for me in the world. She also made me very happy, even without being exquisite. The question of money no plays the role it used to concerning marriage, especially since young couples bravely conquer their partnership together. For example, Ms. Bl.’s successor, who is starting next week on a trial basis, is a young married woman. She plans to bring her 4-month- old baby with her, while her husband (a philologist) will teach in Mannheim. They want to go to Palestine in 2-3 years. However, the baby makes me a little concerned if the position here will work out. The baby will come here later and is with the grandmother for the time being.
